3、mordern one.During this period,people all focus on the interest of shareholders of companies.However,as to the protection of company employees’ rights,company laws in China are less clearly defined. “Labor Laws” and “Lab

4、or Contract Laws” have already defined the relating regulations of the protection of employees’ rights, but this has marginalized their rights.The traditional company law theory is capital-based.But presently the systerm

5、 of company law whose purpose is to protect the rights of capital owners does not adjust to the development of nowadays company theory any more.How to protect company employees’ rights becomes urgent priority of Chinese

6、company legislation. This paper is to elaborate the legislation defects on the employees’ rights protection.Firstly,the paper analysed the present situation of workers rights protection in China.The main contents are the

7、 lacking of voting rights of employees’ participation in the power,weak awareness of rights when workers are signing the employment contract and sufficient of protection on relating worker’s rights.Through borrowing in t

8、he advanced legislation experience of foreign countries and according to Chinese actual situation,Chinese company law systerm should absorb in the advanced experience dialectically. At last,based on the harmonious philos
