2、ntry Abstract Since the reform and opening policy, our country have been promulgated some educational laws and regulations, such as The Education Law, The Compulsory Education Law, The professional Education law, The Hig
3、her Education Law, The Privately-run Education Promotion Law and The Teachers’ Law. But these laws and regulations only standardize macro issues to the educational principles and systems, they are relatively fundamental
4、concerning the rights and obligations of the school. The problems that the legal relations between of all schools at different levels and the government, society, teachers, students and the school’s internal manageable s
5、tructure for theoretical study and system building are still rather weak. This paper sets about analyzing relevant legal relationship with The Schools’ Law and finds out the existing problems. It is based on studying our
6、 educational system of law, though thinking the insufficiency of current school’s legal systems and studying the legislative experience of the developed countries and regions, the paper studies the basic contents of The
7、Schools’ Law in our country which thinks the establishment of The Schools’ Law is to improve all kinds of systems relating to the school, standardize the running of the school, guarantee the legal rights and interests of
8、 teachers and students. In order to standardize the school’ operating mechanism and school’s development, the establishment of The Schools’ Law and other educational laws, handle connection with other departmental laws.
9、Therefore, the school education can really face the needs of modernization, of the world and of the future and we can cultivate a large number of qualified talents who suits the Times’ demands. key words: The Schools’ La
