1、摘要I拒不執(zhí)行錯誤的判決、裁定是否構(gòu)成犯罪－以刑法的價值為視角摘要拒不執(zhí)行判決、裁定罪的犯罪對象是否包括錯誤的判決、裁定(本文所稱的錯誤判決、裁定特指在對行為人定罪量刑時無瑕疵但后來被認(rèn)定為有瑕疵的判決、裁定)這在我國刑法理論界存在很大爭議：有人認(rèn)為應(yīng)當(dāng)包括錯誤的裁判，否則司法權(quán)威和法治秩序就會面臨明顯而即刻的危險；有人認(rèn)為，不應(yīng)當(dāng)包括錯誤的裁判，因為錯誤的裁判從實質(zhì)上而言不具有合法性。本文共由三部分組成：第一部分，以一個案例導(dǎo)入，找出
