簡(jiǎn)介:;譬4辯譬‰蕊器孓譬_■__霹飄躐7F7‘、J、黔第二章;主要研究了民國(guó)時(shí)期成都慈善團(tuán)體的成立時(shí)間、施善形式、經(jīng)費(fèi)狀況及與政府的關(guān)系。第三章主要研究了成都慈惠堂在19241949年間的發(fā)展?fàn)顩r。首先,對(duì)成都慈惠堂的管理機(jī)構(gòu)沿革介紹其次,對(duì)成都慈惠堂各“堂廠”作了詳細(xì)研究。第四章主要研究了成都慈惠堂的經(jīng)費(fèi)來(lái)源及支出。該堂經(jīng)費(fèi)來(lái)源主要包括田地產(chǎn)租金、政府資助、社會(huì)捐助和培根火柴廠的收益。而支出部分則包括事業(yè)費(fèi)用及行政費(fèi)用兩個(gè)方面。第五章主要研究成都慈惠堂與政府的關(guān)系。政府在對(duì)成都慈惠堂進(jìn)行資金支持和一定政治庇護(hù)的同時(shí)也對(duì)它進(jìn)行監(jiān)督核查,甚至在特殊時(shí)期還干預(yù)它的活動(dòng)。而慈惠堂有時(shí)也要利用政府的力量來(lái)幫助它解決一些困難。結(jié)論主要探討成都慈惠堂的特點(diǎn),進(jìn)而說(shuō)明民國(guó)時(shí)期慈善團(tuán)體的辦善的復(fù)雜性和局限性。關(guān)鍵詞民國(guó)時(shí)期社會(huì)救濟(jì)成都慈惠堂Ⅱ

簡(jiǎn)介:法治究竟是什么這既是一個(gè)古老的話(huà)題,也是一個(gè)時(shí)代感較強(qiáng)的話(huà)題。什么是私權(quán)保護(hù)通過(guò)什么治國(guó)方略可以更好地促進(jìn)私權(quán)保護(hù)這也是一個(gè)常議常新并為世人普遍關(guān)注的問(wèn)題,法治建設(shè)的研究碩果累累,而私權(quán)保護(hù)的研究成果不多,尤其將兩者結(jié)合起來(lái)的研究成果還很罕見(jiàn)。本文研究的主要思路、主要內(nèi)容、主要觀點(diǎn)如下一、私權(quán)保護(hù)和法治建設(shè)是一種雙向建構(gòu)過(guò)程。本文運(yùn)用唯物辯證法這一正確的方法論,具體從如下幾方面中西方對(duì)私權(quán)保護(hù)的不同態(tài)度造成中西法治狀況的差異;保護(hù)私權(quán)是法治的基本價(jià)值取向和精神支撐;法治是私權(quán)實(shí)現(xiàn)的基本途徑和保障;中國(guó)法治建設(shè)應(yīng)以“保護(hù)私權(quán)”為前提和基礎(chǔ)來(lái)闡述這一雙向建構(gòu)過(guò)程,認(rèn)為法治不是對(duì)私權(quán)的限制,而應(yīng)該給人最大限度的私權(quán)利。筆者并且認(rèn)為,私權(quán)的發(fā)展是中國(guó)法治建設(shè)的基礎(chǔ)性工程。法治建設(shè)是一個(gè)龐大而艱巨的社會(huì)系統(tǒng)工程,涉及立法、司法、執(zhí)法和護(hù)法等各個(gè)方面,需要多方面的努力,不能指望一墩而就,但只要我們抓住了“保護(hù)私權(quán)”這個(gè)基礎(chǔ)性工程,致力于高素質(zhì)人才的培養(yǎng)和現(xiàn)有法律職業(yè)隊(duì)伍素質(zhì)的全面提高及全民法治觀念的增強(qiáng),則中國(guó)法治大廈的建成指日可待。二、探討了法治建設(shè)與私權(quán)保護(hù)的良性互動(dòng)規(guī)律。本文主要揭示法治建設(shè)與私權(quán)保護(hù)發(fā)展進(jìn)程相互促進(jìn)、相互協(xié)調(diào)的發(fā)展模式,探究了人對(duì)私權(quán)利的追求對(duì)法治建設(shè)的重大意義。指出私權(quán)保護(hù)揭示了法治建設(shè)的任務(wù)和主題,它要求我們?cè)诜ㄖ谓ㄔO(shè)中要充分發(fā)揮主體的積極作用,把人的素質(zhì)、人格、人才的塑造作為法治建設(shè)的出發(fā)點(diǎn)和基礎(chǔ)工程,實(shí)現(xiàn)“私權(quán)高度發(fā)達(dá)”作為法治建設(shè)的終極目標(biāo)和歸宿,實(shí)現(xiàn)人的價(jià)值觀念、道德品格、能力水平、精神狀態(tài)、思維方式等的全面發(fā)展;凸現(xiàn)了轉(zhuǎn)型期法治建設(shè)的必要性和緊迫性;表征了法治建設(shè)的哲學(xué)維度,認(rèn)為以馬克思哲學(xué)為基礎(chǔ)的法治建設(shè)的哲學(xué)維度也自然是對(duì)人的私權(quán)的價(jià)值追求。并論證了法治不是對(duì)私權(quán)的否定,而是實(shí)現(xiàn)私權(quán)高度發(fā)達(dá)的最佳路徑。三、保護(hù)私權(quán)是對(duì)法治建設(shè)的要求。本文在進(jìn)行調(diào)查研究掌握第一手材料的基礎(chǔ)上,著重闡明了如下觀點(diǎn)一是為了保護(hù)私權(quán)必須鑄造法治之魂,法治之魂是指在法治建設(shè)中起創(chuàng)建性作用的法律的情感價(jià)值,即公眾對(duì)法律的真誠(chéng)信仰。二是為了保護(hù)私權(quán)必須重構(gòu)法治的精神基礎(chǔ),重構(gòu)當(dāng)代法治人文精神基礎(chǔ)必須是西方和中國(guó)傳統(tǒng)人文精神的整合,它不是原有中西人文精神一般的組合,而是經(jīng)過(guò)創(chuàng)造性的轉(zhuǎn)化后的中西人文精神所構(gòu)成的有機(jī)體。三是為了保護(hù)私權(quán)必須重視法治的私權(quán)張揚(yáng)。根據(jù)我國(guó)國(guó)情,法治的私權(quán)張揚(yáng)即私權(quán)的法律保護(hù)的基本途徑有私權(quán)的憲法保護(hù)、私權(quán)的部門(mén)法保護(hù)、私權(quán)的司法保障等。

簡(jiǎn)介:華東政法大學(xué)碩士學(xué)位論文構(gòu)建工會(huì)與企業(yè)社會(huì)責(zé)任良性互動(dòng)機(jī)制姓名張軍寶申請(qǐng)學(xué)位級(jí)別碩士專(zhuān)業(yè)經(jīng)濟(jì)法學(xué)指導(dǎo)教師董保華20080420工標(biāo)準(zhǔn)實(shí)現(xiàn)的角度對(duì)工會(huì)與企業(yè)社會(huì)責(zé)任的互動(dòng)進(jìn)行了有益的探索。這部分首先介紹了核心勞工標(biāo)準(zhǔn)的四個(gè)方面的具體內(nèi)容緊接著筆者分析了國(guó)際勞工組織如何通過(guò)工會(huì)推動(dòng)核心勞工標(biāo)準(zhǔn)的實(shí)現(xiàn);然后又分析了國(guó)際勞工組織推動(dòng)核心勞工標(biāo)準(zhǔn)實(shí)現(xiàn)的另一種形式企業(yè)社會(huì)責(zé)任;最后得出結(jié)論工會(huì)與企業(yè)社會(huì)責(zé)任是可以實(shí)現(xiàn)互動(dòng)的,兩者的互動(dòng)能夠促進(jìn)勞工權(quán)益在更大的范圍內(nèi)得到更多的保護(hù)。第四章考察了法國(guó)和美國(guó)工會(huì)與企業(yè)社會(huì)責(zé)任兩種不同的運(yùn)行模式,這部分首先介紹了美國(guó)的工會(huì)具有工聯(lián)主義傳統(tǒng),工會(huì)與企業(yè)人力資源管理進(jìn)行合作,兩者呈現(xiàn)良性互動(dòng)的態(tài)勢(shì),有效地保障了工人的權(quán)益,實(shí)現(xiàn)了勞資和諧;接著第二部分介紹在法國(guó)的工會(huì)與企業(yè)社會(huì)責(zé)任關(guān)系中,工會(huì)一枝獨(dú)大,淪為既得利益代表,過(guò)分做大工會(huì)有可能讓社會(huì)付出巨大的成本。第五章談了實(shí)現(xiàn)工會(huì)與企業(yè)社會(huì)責(zé)任良性互動(dòng)的途徑。在工會(huì)與企業(yè)社會(huì)責(zé)任良性互動(dòng)的機(jī)制中,筆者認(rèn)為首先必須增強(qiáng)工會(huì)的獨(dú)立性,進(jìn)行機(jī)制重塑;其次企業(yè)應(yīng)該站在制高點(diǎn)上看待企業(yè)社會(huì)責(zé)任,自愿或自律擔(dān)負(fù)社會(huì)責(zé)任,保護(hù)勞工權(quán)益;在此基礎(chǔ)上,筆者提出了構(gòu)建工會(huì)與企業(yè)社會(huì)責(zé)任良性互動(dòng)機(jī)制的若干建議。I關(guān)鍵詞L工會(huì)企業(yè)社會(huì)責(zé)任核心勞工標(biāo)準(zhǔn)良性互動(dòng)
